By accessing or using InfoAIgraphic, an AI-powered tool that turns user inputs into infographics (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using InfoAIgraphic, an AI-powered tool that turns user inputs into infographics (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

2. Eligibility & Accounts

You must be able to form a legally binding contract. We do not knowingly provide the Service to children under 13 (or under 16 in the EEA/UK where local law requires parental consent).

Sign-in methods: email+password and Google OAuth. You are responsible for safeguarding your credentials and for activity under your account.

3. Credits, Pricing & Taxes

The Service is sold on a one-time, credit-based model (no subscription, no auto-renew). Each generation consumes credits as indicated in-app.

No refunds. All sales of credits are final once access is granted/delivered.

Payments are processed by Stripe. Taxes (e.g., VAT/sales tax) may be calculated and collected by our payment processor where available; you remain responsible for any additional taxes or duties applicable in your jurisdiction.

Credits have no cash value, are non-transferable/non-assignable, and may not be resold. We may adjust pricing or credit consumption at any time, with changes applying prospectively.

4. Your Content & Outputs

"User Content" includes prompts, text, images/logos you upload, and generated infographics/outputs.

Ownership of outputs: You own the outputs (infographics) you generate, together with any rights you can lawfully obtain in your jurisdiction.

License to us (limited): You grant us a non-exclusive, worldwide, royalty-free license to host, process, transmit, and display User Content and outputs solely to operate the Service (e.g., rendering, storage, backups, support). Outputs are private by default; we will not publish or use them for marketing unless you opt-in.

No training: We do not use your prompts or outputs to train our models. Where we send data to third-party AI providers, we configure settings and agreements to prevent training and restrict use to providing the Service.

5. Acceptable Use

You agree not to (and not to permit others to):

  • use the Service for unlawful content/activity;
  • infringe IP or privacy rights;
  • generate or disseminate hateful, harassing, discriminatory, sexually exploitative, or violent content;
  • create malware, attempt unauthorized access, or interfere with Service integrity;
  • scrape, bulk-download, or reverse engineer models;
  • use the Service or outputs to train, fine-tune, benchmark, or build competing AI models or datasets, or to improve third-party AI systems, without our prior written consent;
  • use the Service in regulated, high-risk contexts (medical, legal, financial, government decision-making) where professional validation is required.

6. Third-Party Services & AI Providers

We rely on third-party infrastructure and AI APIs (e.g., OpenAI and Google) to deliver the Service. Your use is also subject to their terms/policies. We do not control third-party services and are not responsible for their acts or omissions.

7. Disclaimers (AI & Accuracy)

AI-generated outputs may be incorrect, incomplete, or non-original. You are solely responsible for reviewing, fact-checking, and using outputs. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind (including merchantability, fitness for a particular purpose, and non-infringement).

8. Intellectual Property (Service)

We (and our licensors) own the Service, software, and all related IP. Except for rights expressly granted, no rights are implied. You may not copy, modify, or create derivative works of the Service.

9. DMCA / Copyright Complaints

If you believe content infringes your rights, contact our DMCA agent: contact@infoaigraphic.com with details of the alleged infringement. We may remove content and/or suspend accounts in accordance with applicable law.

10. Termination & Suspension

We may suspend or terminate access for breach of these Terms, risk to the Service, or legal compliance. You may stop using the Service at any time. Upon termination, your license to use the Service ends; sections that by nature should survive (e.g., IP, disclaimers, liability, dispute resolution) will survive.

11. Limitation of Liability

To the maximum extent permitted by law:

No consequential damages. We will not be liable for incidental, special, exemplary, or consequential damages, lost profits/revenue, or loss of data.

Liability cap. Our aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amounts you paid to us in the 12 months preceding the claim, or (b) US$100 (if no purchase was made).

12. Indemnity

You will defend and indemnify us from third-party claims arising from your unlawful use of the Service or violation of these Terms.

13. Export Controls & Sanctions

You must comply with applicable export control and sanctions laws and may not use the Service in embargoed or restricted jurisdictions.

14. Governing Law & Dispute Resolution

Governing law: Singapore law (without regard to conflicts of law).

Arbitration (neutral): Except where prohibited by consumer law, any dispute will be finally resolved by arbitration under SIAC Rules by one arbitrator, seat Singapore, language English.

Consumer carve-out: If you are a consumer resident in the EEA/UK, you may bring claims in your local courts and rely on your mandatory consumer protections.

15. Changes to the Service or Terms

We may update these Terms. For material changes, we will notify you by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.
